The greatest tennis player that has ever lived…that grew up on a Christmas tree farm in Northern Michigan (if you don’t count his brother Luke). After winning the 1993 French Open with his brother Luke, the Jensen brother became the most popular doubles team in the history of the game.

• Please read below the following Legends Camp Booking Terms and Conditions carefully.
• Please carefully review the above and below details before paying for your package.
• In the event of any errors with this Agreement, immediately notify us before buying your package.
• Any amendments are to be notified in writing, and are not confirmed until written acceptance confirming changes has been received from Premier Tennis.
• Signing this agreement electronically or by making payment of your non-refundable deposit constitutes agreement and understanding of these terms and conditions.
• The company Premier Tennis can make no guarantees that advertised ATP / WTA Players will arrive, attend, and stay for the Camp or Charity Exhibition, Dinner, Auction and Party. Company will have no liability in the event that such players do not attend these events.
• Please note that all payments are non-refundable and once paid can’t be charged back by your credit card company.
• Guest rooms will be available at 3:00pm on arrival day and reserved until 12:00pm on departure day.  Early arrivals and late departures are at the discretion of Rosewood Little Dix Bay management, must be approved in advance, in writing, and may incur an additional cost.
• There will be a 2% Service Fee for any credit card transactions.
   

2015 LEGENDS CAMP AT ROSEWOOD LITTLE DIX BAY - BOOKING TERMS AND CONDITIONS

1: DEFINITIONS AND PARTIES

In these terms and conditions: The ‘Company’ shall mean Premier Tennis Group, LLC - DBA Premier Tennis, a limited liability company organised under the laws of the State of Georgia, United States. ‘We’ shall mean the Company. The ‘Client’ shall mean the person who has paid the full non-refundable deposit as the ‘Lead Booking Name’ and each person listed within the booking as a travelling companion. ‘You’ shall mean the Client. ‘Necker Island’ or “Necker” shall mean Necker Island BVI, Limited, a limited company under the laws of the BVI “Rosewood Little Dix Bay” or “LDB” shall mean Rosewood Hotel and Resorts and Rosewood Little Dix Bay Hotel LLC, a corporation organized under the laws of the BVI.  In these conditions the masculine words shall include the feminine and neuter genders and vice-versa and the singular shall include the plural and vice-versa.

2: BOOKINGS

A contract will only be constituted between the Company and the Client once either a payment has been received by the Company from the Client or by Client signing these Booking Terms and Conditions ( “Agreement”) to participate in the 2014 Ice Swan Legends Camp , (hereinafter“Camp”).  The Company will issue a booking confirmation invoice to the Client after receiving the required payment either from or expressly on behalf of the Lead Booking Name as stated under ‘Payment and Confirmation’. The Lead Booking Name, on paying the agreed fee, warrants and confirms to the Company that he accepts these terms and conditions on behalf of himself and each of his travelling companions.  Notwithstanding the foregoing, each adult among the Client group is required to execute these Terms and Conditions as a condition of your/their Stay.

3: PAYMENT AND CONFIRMATION

Bookings for accommodations and spot(s) in the Camp will be confirmed upon receipt of a non-refundable payment. If paying in a different currency, an exchange rate will be agreed at the time of payment. All payments are Non-Refundable once made.  Client agrees that they will not attempt to charge back, nor have any right to chargeback, any credit card transactions from Credit Card Merchants after this Agreement has been executed or payment has been made.

4: ADDITIONAL FEES
By placing a credit card or ACH direct payment account on file with us you authorize us to charge your card for any purchases made during the Necker Cup Auction, as well as any unpaid fees and incidentals you accrue at Rosewood Little Dix Bay or Necker Island as a result of your Stay.  All food, beverage, accommodations, and Resort amenities except spa treatments are included with your Travel Package. You may revoke your authorization by sending us a written request at the address below. We may continue to bill your credit card or direct payment account for any fees for any services rendered or actions by you or by us taken prior to the receipt of your written revocation.

On Necker Island you will not be allowed to use Island Amenities except for the purposes of attending the Charity Exhibition, Dinner, Auction and “End of the World” Party on November 21, 2015.

BY USING A CREDIT CARD YOU HEREBY UNCONDITIONALLY WAIVE ANY AND ALL CHARGEBACK RIGHTS YOU MAY HAVE. 

If you have any question about a charge on your credit card, contact us as described in Section 5 below.

5: CANCELLATION BY THE CLIENT

As with any travel, we strongly recommend that you purchase travel insurance which may give you full cancellation coverage. You must send us any and all cancellations clearly and in writing to avoid any errors! This can be done by letter, fax or email using the following contact details:

We will then confirm the cancellation back to you in writing and give you a cancellation number. If requested, we can also provide letters indicating that your payments have been forfeited in order to assist you with any travel insurance claims. All payments are non-refundable.  In the event that Client cancels their travel package, there will be no refunds and Company has no further obligation to the Client.

6: CHANGES BY THE CLIENT TO THE DATE OR NATURE OF A BOOKING

Requests for changes to the date or nature of a booking (including, for example, as to numbers) will be dealt with on a case by case basis and approved or rejected (in whole or in part) at the sole discretion of the management at the Company. All payments are non-refundable. Should you choose to leave the event early for any reason no refund will be made to you nor will alternative dates be arranged. The Client also agrees that your travel package cannot be sold, awarded as prizes, assigned, sublet or otherwise transferred without the Company’s prior written authorisation.

7. SPECIAL REQUESTS
If you have any special requests in connection with your itinerary, you must submit them to the Company at the time you book your reservation. We will pass along any requests we deem reasonable to the relevant service providers. We cannot guarantee, however, that the service providers will fulfil such requests, as such services or amenities may not be available. Company is not liable for any failure to fulfil a special request, and no cancelation due to any special request not being met shall be allowed. Company does not accept booking requests conditioned or contingent on the fulfilment of a special request.

8: LIABILITY OF THE COMPANY

1. We accept no liability for ensuring that the accommodation which you book with us is provided as described in the Legends Camp brochure or website: www.premiertennis.com

YOU AGREE THAT YOUR STAY AT ROSEWOOD LITTLE DIX BAY, VISIT TO NECKER ISLAND, AND PARTICIPATION IN THE CAMP ARE ENTIRELY AT YOUR OWN RISK.  THE STAY AND THE CAMP ARE PROVIDED ON AN "AS IS" "AS AVAILABLE" BASIS WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND WHATSOEVER, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, NON-INFRINGEMENT, TITLE, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

b) For the avoidance of doubt neither the Company nor Rosewood Hotels & Resorts, nor Rosewood Little Dix Bay, nor the National Tennis Foundation, nor Necker Island nor Aguas Glaciar S.A. nor event sponsors nor event partners will be liable for loss or injury suffered by the Client other than those resulting from Company’s gross negligence or willful misconduct. We would suggest that you obtain suitable insurance to cover such loss or injury. The Company shall not be obligated to make any payments in those circumstances save where otherwise provided for in the terms and conditions above.

c) Under no circumstances will the Company nor Rosewood Hotels & Resorts, nor Rosewood Little Dix Bay, nor the National Tennis Foundation, nor Necker Island nor Aguas Glaciar S.A, nor event sponsors nor event partners will be liable to the Client for any Indirect Damages as a result of Client’s Stay, these Terms and Conditions or their breach, or any change or cancellation of Client’s Stay or the Event.  ‘Indirect Damages’ shall mean any consequential, special or indirect damages, financial recompense, loss of revenue/profits/business, or loss of time.

d) We make no guarantees or accept no liability or make any refunds in the event that Sir Richard Branson or any of the advertised  ATP / WTA Player’s who are affiliated with the Ice Swan Necker Cup, Camp, Exhibition, Party or any other activity cancel prior to the event date, can’t make the Event due to travel or weather related issues, injury, sickness, or for any reason whatsoever, or are forced to leave the Camp or event during the event or at any time for any reason whatsoever.

e) Under no circumstances will the Company nor Necker Island or The National Tennis Foundation or Aguas Glaciar S.A or event partners or event sponsors be liable to the Client for any personal injury that may arise from either air, ground or boat transportation during the event.

9: INDEMNIFICATION

Moreover, In consideration of Company allowing each adult participant (each, a “Participant”) and any minors accompanying such Participants (each, a “Minor”) to participate in the Camp, and in consideration of Necker Island allowing Participant to visit Necker Island to participate in the Charity Exhibition, Dinner, Auction and Party, to the fullest extent permitted by law, Participant on behalf of him/herself and all Minors hereby releases Company, National Tennis Foundation, Necker Island, Rosewood Little Dix Bay, Rosewood Hotels and Resorts, Aguas Glaciar S.A, event partners and event sponsors and their respective principals, affiliates, officers, agents and employees  (“Releasees”) from any and all liability for bodily injury, death or property damage, from whatever cause, including any act or failure to act, whether negligent or otherwise, of any of the Releasees, arising out of or relating in any way to Participant’s or Minors’ presence at Little Dix Bay or Necker Island or participation in the Camp (but excluding any gross negligence or wilful misconduct by Releasees).  In further consideration, at Company's request, Participant will defend all claims, legal and/or regulatory proceedings arising out of the acts or omissions of Participant and Minors during their Stay at both Rosewood Little Dix Bay and Necker Island. To the full extent permitted by applicable law, Participant will indemnify Releasees for all expenses (including reasonable attorneys’ fees, settlements, and judgments) incurred by any of the Releasees in connection with such claims.  Participant's obligation to defend and indemnify will apply regardless of whether the claim arises in tort, negligence, contract, warranty, strict liability or otherwise.

If Client is a California resident, you waive California Civil Code §1542, which says:  "A general release does not extend to claims which the creditor does not know or suspect to exist in his favor at the time of executing the release, which if known by him must have materially affected his settlement with the debtor."

10: WAIVER AND RELEASE FORM REQUIREMENT

A separate Waiver and Release of Liability, Assumption of Risk and Indemnity Agreement will be required to be signed by all participants upon arrival at the event site.

11. PHOTOGRAPHY/VIDEOGRAPHY RELEASE

I do hereby grant to Company, Rosewood LDB, Necker Island, the National Tennis Foundation, and its employees or assigns, permission to photograph or video me and members of my family, in a manner for marketing The Necker Cup, The Legends Camp and the fundraising efforts of The National Tennis Foundation. I agree that Company and The National Tennis Foundation can use such photographs and video, with or without my name, for any lawful purposes to include publication, display, promotion, advertising, editorial illustration and web use.

12: FORCE MAJEURE

No damages or refunds shall be due for a failure of performance occurring due to Acts of God, war, terrorist act, hurricanes, adverse weather, government regulation, riots, disaster, or strikes, any one of which make performance impossible. Rosewood Little Dix Bay and Necker shall have no liability for power disruptions of any kind.

13. INSURANCE

Given the nature of travel services, we recommend that you obtain independent insurance to provide adequate cover for medical expenses, personal accident, loss of baggage and curtailment or cancellation of your trip. Please note that such insurance is not included with your purchase unless you separately purchase such insurance from a third party provider of insurance services.

If for some unforeseen reason you must cancel your journey, your deposit is non-refundable. It is strongly recommended that you purchase travel insurance. One option is Travelex Insurance, which offers Trip Cancelation, Trip Interruption, Trip Delay and Baggage Insurance. 14: ENTIRE AGREEMENT; VARIATION AND WAIVER; SEVERANCE

These Terms and Conditions constitute the entire understanding and agreement in relation to their subject matter and supersede any previous explicit or implied agreement, undertaking or course of conduct between the parties with respect thereto. The Company reserves the right to alter these Terms and Conditions from time to time and will notify the Client of any changes as soon as reasonably possible using the postal or email contact details provided by the Client for the Client’s booking.  The amended terms and conditions will apply to any Client booking that commences after the date of such notification.   No other variation, waiver or release of these Terms and Conditions shall be effective unless it is made by the Company in writing and notified to the Client in accordance with this paragraph. If any part of these Terms and Conditions is void or unenforceable due to any applicable law, it shall be deemed to be deleted and the remaining provisions of these Terms and Conditions shall continue in full force and effect.

15: GOVERNING LAW

The laws of the State of Georgia, excluding its choice of law rules, govern all matters arising out of this Agreement, including all tort claims.    Any dispute or claim arising out of or relating to the Event, these Terms and Conditions or their breach, termination or invalidity, or any cancellation shall be finally settled by arbitration by a single arbitrator in accordance with the rules of the American Arbitration Association applying the substantive law of the State of Georgia without regard to any conflict of laws provisions.  Judgment upon the award rendered by the arbitrator may be entered by any court with jurisdiction.  The arbitrator(s) shall not be empowered to award damages in excess of compensatory damages and each party waives any damages in excess of compensatory damages that are proven; however, the prevailing party in any action shall be entitled to all reasonable fees incurred (attorneys’ fees, filing fees, etc.) incurred as a result of such proceeding.  The arbitration will be held in Atlanta, GA.

Notwithstanding the provisions of this section, either party may bring a claim for injunctive relief before a court with jurisdiction without first submitting the claim to arbitration. Premier and Participant each agree to indemnify the other in full for all attorneys’ fees incurred by the other to dismiss claims brought other than in accordance with the undertakings above.  For clarity, Necker Island is not a party to and is not bound by any obligation in these Terms and Conditions, but is an intended third party beneficiary of the undertakings of Participant hereunder.

16. ENTIRE AGREEMENT

This Agreement sets forth the entire Agreement between the parties, and supersedes any and all prior agreements between them, relating to the Images. No amendment or modification of any provisions of this Agreement will be valid unless set forth in a written instrument signed by both parties.
